Review and Compliance Federal and state laws provide that the State Historic Preservation Officer review certain federal and state "undertakings." This process is commonly known for federal projects as Section 106 of the National Historic Preservation Act of 1966 (as amended) and as Section 11.1 for state projects. These are projects which include governmental funding, licensing, and many other forms of involvement. These projects are reviewed to ensure compliance with the appropriate historic preservation laws which require that the governmental agency consider cultural and historic properties in their planning. In carrying out its role in this process, the SHPO reviews an average of 2,000 federal undertakings each year. Most of these do not affect any historic properties. Approximately three percent affect historic properties, but the effects are determined not to be adverse. Only one percent are determined to have adverse effects to historic properties and memorandums of agreement are negotiated to avoid, minimize, or mitigate these effects if possible. The review and compliance activity has been highly successful in preventing the inadvertent destruction of historic properties resulting from activities of the federal government.
